Welcome to Joelino Fine Art & Home Design. The following Terms and Conditions (“Terms”) govern your access to and use of the website located at joelinoart.com (the “Site”) and any purchase of products, commissions, or services offered by Joelino Fine Art & Home Design (“Joelino,” “we,” “our,” or “us”). By visiting the Site, placing an order, or engaging our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. About Joelino Fine Art & Home Design

Joelino Fine Art & Home Design is the online home of artist Joel Miller, presenting original paintings, works on paper, limited-edition canvas prints, and a curated Home Design collection of pillows, lumbar pillows, ottomans, coasters, and related accent pieces. Our Home Design pieces are produced in collaboration with selected manufacturing partners in the United States and are custom made to order, reflecting the same attention to proportion, craftsmanship, and visual storytelling found in Joel Miller’s paintings.

2. Acceptance of These Terms

By using the Site or purchasing from Joelino, you represent that you are at least eighteen (18) years of age and legally able to enter into a binding contract. If you are using the Site on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to any portion of these Terms, please do not use the Site or place an order.

3. Intellectual Property & Copyright

All content on the Site — including but not limited to photographs, images, paintings, works on paper, product designs, text, graphics, video, logos, page layouts, and the selection and arrangement thereof — is the property of Joel Miller and/or Joelino Fine Art & Home Design and is protected by United States and international copyright laws. All rights are reserved.

The purchase of an original artwork, print, or Home Design piece conveys ownership of the physical object only. It does not transfer copyright, reproduction rights, moral rights, or any intellectual property rights in the underlying artwork. Purchasers may not reproduce, copy, photograph for commercial use, modify, create derivative works from, distribute, publicly display, or otherwise exploit any artwork or imagery without the prior written consent of Joelino Fine Art & Home Design.

4. Trademarks

“JOELINO,” “JOELINO FINE ART,” and “JOELINO FINE ART & HOME DESIGN,” together with the Joelino logo, are trademarks and service marks of Joelino Fine Art & Home Design, and are the subject of pending applications with the United States Patent and Trademark Office. You may not use these marks, or any confusingly similar marks, without our prior written permission.

5. Products, Availability & Made-to-Order

Original paintings and works on paper are one-of-a-kind and sold on a first-come, first-served basis. Once an original is sold, it is no longer available. Limited-edition canvas prints are produced in a finite run.

All Home Design products — pillows, lumbar pillows, ottomans, coasters, and related accent pieces — are custom made to order. Please allow up to forty-two (42) days for completion and delivery following the confirmation of your order. Because each piece is produced individually and uniquely for you, custom orders are non-refundable and non-exchangeable except as expressly set forth in Section 9 below.

We make every effort to display colors, finishes, and textures accurately on the Site. However, the actual appearance of a painting, print, fabric, or finish may vary slightly due to monitor calibration, lighting, and the inherent variation of handmade work. Minor variation is a characteristic of handcrafted art and is not considered a defect.

6. Orders, Pricing & Payment

All prices are displayed in U.S. Dollars (USD) and, where applicable, include standard shipping, handling, and insurance within the continental United States, as well as any applicable sales tax. Prices are subject to change at any time without notice, provided that any change will not affect an order that has already been accepted and confirmed by us.

Placing an order constitutes an offer to purchase; an order is only accepted upon our written confirmation and, where applicable, successful charge of your payment method. We reserve the right to refuse or cancel any order, limit quantities, or correct any errors in pricing or product information at our sole discretion, including after an order has been submitted.

Payment is processed through our third-party payment providers. By submitting payment information, you represent that you are authorized to use the designated payment method and authorize us (and our payment processors) to charge the amount of your order to that method.

7. Shipping & Delivery

Joelino currently offers complimentary shipping, handling, and insurance on all orders shipped within the continental United States. International shipping is not available at this time; we intend to expand these services in the future.

Estimated delivery timeframes:

• Original paintings and limited-edition canvas prints: typically one (1) to three (3) weeks from order confirmation.
• Home Design pieces (pillows, lumbar pillows, ottomans, coasters): custom made to order — please allow up to forty-two (42) days for completion and delivery.

Delivery timeframes are estimates only and are not guaranteed. Risk of loss and title for items purchased pass to you upon our delivery of the item to the common carrier.

8. Order Changes & Cancellations

Requests to change or cancel an order must be submitted in writing to hello@joelinoart.com within twenty-four (24) hours of placing the order. After twenty-four (24) hours, orders are final and cannot be cancelled or refunded, except in the limited circumstances described in Section 9.

9. Exchanges, Returns & Damaged Items

Exchanges (Home Design accent pieces only). Exchange requests must be submitted in writing within seven (7) days of delivery or pick-up. Items must be returned in their original, unused condition and in their original packaging. A restocking fee of thirty-five percent (35%) will apply, along with inbound and outbound shipping charges, which are the responsibility of the customer.

Damaged Items. Refunds are issued only for items that arrive damaged as a result of shipping. Proof of damage — including photographs of the damaged item and its packaging — must be provided to hello@joelinoart.com on the day of delivery. Upon receipt of acceptable proof, we will email a return label and, after inspection of the returned item(s), process the applicable refund.

Custom and Commissioned Work. Custom-made and commissioned works are non-refundable and non-exchangeable under any circumstances other than shipping damage as described above.

Original Artworks. Sales of original paintings and works on paper are final.

10. Care & Use of Home Design Products

Marine Vinyl covers are weather-resistant, UV-treated, mold- and mildew-resistant, and suited for indoor and outdoor use. They should be wiped down with a damp cloth only and must not be placed in a dryer. Ottomans are crafted exclusively in Marine Vinyl and are designed for indoor and outdoor use, but are not intended for prolonged exposure to direct rainfall.

Supernova fabric covers are intended for indoor use only and should be spot-cleaned gently with mild soap and water. Harsh chemicals and abrasives should not be used.

Joelino is not responsible for damage resulting from improper care, misuse, or failure to follow the care instructions provided with each product.

11. Commissions, Corporate & Hospitality Projects

Joelino accepts inquiries for private commissions and for large-scale corporate, hospitality, residential development, and interior design projects. Commissions and project engagements are subject to a separate written agreement that will govern scope, schedule, deposit, milestone payments, approval process, delivery, installation, and any applicable usage rights. Nothing on the Site constitutes a binding offer to create a commissioned work; all commissions are accepted at our discretion. Inquiries may be directed to info@joelinoart.com.

12. Authenticity

Every original painting and work on paper by Joel Miller is signed by the artist. Each Home Design piece bears the artist’s signature on the base seam. Certificates of authenticity are issued with original works and limited-edition prints upon request.

13. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use and enjoyment of the Site by any third party. You may not (a) upload or transmit any unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable content; (b) attempt to gain unauthorized access to any portion of the Site, its servers, or related infrastructure; (c) use any robot, spider, scraper, or similar automated means to access the Site other than publicly available search-engine crawlers; or (d) interfere with or disrupt the operation of the Site or the networks connected to it.

14. Third-Party Links

The Site may contain links to third-party websites, services, or resources (including but not limited to social media platforms and linktr.ee) that are not owned or controlled by Joelino. We are not responsible for the content, privacy practices, or availability of any third-party site, and the inclusion of a link does not imply endorsement.

15. Disclaimer of Warranties

The Site and all content, products, and services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by applicable law, Joelino disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, nor that any defects will be corrected.

16. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Joelino Fine Art & Home Design, Joel Miller, or any of our affiliates, officers, employees, agents, or manufacturing partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Site or the purchase of any product, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the purchase of any product shall not exceed the amount actually paid by you for the product giving rise to the claim.

17. Indemnification

You agree to indemnify, defend, and hold harmless Joelino Fine Art & Home Design, Joel Miller, and their respective affiliates, officers, employees, agents, and manufacturing partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your use of the Site, (b) your breach of these Terms, or (c) your violation of any rights of a third party, including any intellectual property rights.

18. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review the Privacy Policy to understand how we collect, use, and protect your personal information.

19. Governing Law & Venue

These Terms and any dispute arising out of or related to them or to the Site shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. You agree that any action or proceeding shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.

20. Changes to These Terms

Joelino reserves the right to modify or replace these Terms at any time in its sole discretion. The most current version will always be posted on this page with a revised “Effective Date.” Your continued use of the Site after any such change constitutes your acceptance of the revised Terms.

21. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy and any order confirmation, commission agreement, or other written agreement you enter into with Joelino, constitute the entire agreement between you and Joelino with respect to the subject matter hereof and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
